Freedom of Information Acts (FOIA) are valuable legal tools to access information held by public authorities but during the first wave of the Covid-19 pandemic time frames to reply to requests were de jure or de facto suspended in many countries. However, the lack of effective legal tools to achieve transparency was not automatically paired with governmental secrecy. This research paper analyses which are the factors that prompted some governments to move from secrecy to transparency while the essential legal tool (...) to achieve disclosure of information was not available. It focuses on the role of ‘ecologies of transparency’, a concept developed by Seth Kreimer to describe how FOIA needs to be understood as functioning within a collection of factors and actors. Yet, can transparency ecologies still force disclosure of information when FOIA is suspended? Research focuses on a comparative case study about transparency of scientific committees advising governments on Covid-19 in the UK and in Spain. In both countries, members and minutes were initially secret, but the British government published information before being forced by FOIA, while the Spanish executive only released partial information when FOIA was reactivated. The paper argues that information disclosure processes can be understood as supply and demand models. On the demand side, it highlights the role of adversarial press, scientific community, whistle-blowers, the opposition and critics within the governing party as decisive factors within the transparency ecology. On the supply side, it focuses on legitimation needs from the government to explain different outcomes. (shrink)

Los resultados demuestran cómo las prácticas y actitudes de los jóvenes varían en función de su origen familiar: los que han nacido en un entorno agrario (agricultores tradicionales) son más propensos a seguir las prácticas agrícolas dentro de un paradigma convencional, mientras que los jóvenes que provienen de familias no agrarias (agricultores nuevos) muestran características distintas más cercanas a un nuevo paradigma. This paper offers a novel, qualitative approach to evaluating the outcomes of integrating humanities and ethics into a newly revised pre-clerkship medical education curriculum. The authors set out to evaluate medical students’ perceptions, learning outcomes, and growth in identity development. Led by a team of interdisciplinary scholars, this qualitative project examines multiple sources of student experience and perception data, including student essays, end-of-year surveys, and semi-structured interviews with students. Data were analyzed using deductive and inductive processes to identify key categories (...) and recurring themes. Results suggest that students not only engaged with the curricular content and met the stated learning objectives but also acknowledged their experience in the humanities and ethics curriculum as an opportunity to reflect, expand their perceptions of medicine (and what it means to be “in” medicine), connect with their classmates, and further cultivate their personal and professional identities. Results of this qualitative study show how and in what ways the ethics and humanities curriculum motivates students past surface-level memorization of factual knowledge and encourages thoughtful analysis and evaluation about how the course material relates to and influences their thinking and how they see themselves as future doctors. The comprehensive qualitative approach reflects a holistic model for evaluating the integration of humanities and ethics into the pre-clerkship medical education curriculum. Future research should examine if this approach provides a protective factor against the demonstrated ethical erosion and empathy decrease during clinical training. (shrink)

Popular imaginings of Tanzania's Serengeti National Park and Ngorongoro Conservation Area are founded on the idea of wilderness preserved, but this conception of the 'park' is based in colonial-era race-thinking. Rather than simply a colonial-era manifestation of an apparently universal conservationist ideal, Serengeti and Ngorongoro are instead racial projects that embody the historical and ongoing processes of racial formation. The creation of Serengeti and Ngorongoro enabled a racialisation of nature, a process begun by the British and reinscribed via safari ever (...) since. Recognising this racialisation of nature has larger implications for not only the treatment and perception of those in the Global South, the racialised 'other' to the Global North, but also for the realities of white privilege and constructions of whiteness. This essay advocates applying a “narrative” conception of the individual self to the problem of “collective responsibility.” Participants in the debate agree that groups are composed of individuals and that group responsibility must somehow mimic individual responsibility. However, participants do not begin from a neutral and unproblematic conception of the individual. So far, most participants have assumed standard models of the individual that may unduly bias their conclusions about different forms of group responsibility. I argue that switching to a “narrative” (...) conception may provide a more comprehensive and therefore preferable starting point for considering questions of group responsibility. (shrink)

Andrew Aberdein recently explored whether Aristotle held a (proto-)virtue argumentation theory, which would evaluate a good argument in terms of whether the arguers engaged virtuously. Aberdein admits, however, that connections between virtue, character, and argumentation are scarce within Aristotle's works. Accordingly, here Cassie Finley approaches this question from a different angle, comparing Aristotle's concepts of dialectic and rhetoric with virtue theories of argumentation. She argues that the essential features of dialectic and rhetoric are in tension with the defining characteristics of (...) virtue argumentation theories. However, this tension raises a deeper methodological tension within virtue argumentation theories regarding their “intuitive” conception of arguments. Finley outlines a more viable route forward for virtue argumentation theorists, one that dissolves this tension through reframing their project as a virtue dialogue theory. This shift toward dialogue would help to assuage the main objections to virtue argumentation theories regarding adversariality, incompleteness, and vulnerability to ad hominems. At the same time, developing toward a virtue dialogue theory better aligns with the intuitive sense of engaging well with others that defines the virtue argumentation project, and it also more fruitfully sets up the project to encourage future scholarship connecting virtue ethics, virtue epistemology, and philosophy of education. Derogatory terms can be powerful mechanisms of subordination, while re-appropriating these terms can be a strategy to fight back against social injustice. I argue that projects seeking to reclaim slurs have a performative structure that raises particular hazards. Whereas more familiar forms of protest may fail to bring about their intended result, attempts to re-appropriate slurs can fail to be understood as transgressive acts at all. When attempts at reclamation fail, their force is distorted; context and convention lead the hearer (...) to give uptake to the speech act as a traditional deployment of the slur. The force of this traditional use is to validate and re-entrench the very norms the act was intended to subvert. This is the precarious structure of reclamation projects: when successful, reclamation is the subversion of powerful mechanisms of oppression, but when unsuccessful, the act has the ironic force of constituting mechanisms of oppression. Traditional moral explorations of sexual violation are dyadic: they focus on the relationship between the perpetrator and the victim, considered in relative isolation. We argue that the moral texture of sexual violation and its fallout only shows up once we see acts of sexual violation as acts that occur within an ecosystem. An ecosystem is made up of dwellers and an environment embedded in a broad, thick, interdependent, and relatively stable web of norms, practices, environments, material and institutional structures. We (...) argue that many of the important and interesting harms wrought by sexual violation can only be understood as ecological harms. To illustrate this, we focus on sexual violations that occur within a specific type of ecosystem, namely an academic department with a graduate program. We examine the possible damaging effects of sexual violation on the ecology of a department. We also consider what makes an ecosystem resilient and relatively able to self-repair, and how sexual violation within an ecosystem may weaken its self-repairing resources. We show that looking at sexual violation through this ecological lens lets us identify harms that are otherwise obscured or difficult to locate. (shrink)

This essay addresses one of the central questions in the ongoing debate about just war theory: are soldiers morally responsible for serving in unjust wars? Francisco de Vitoria addressed this question in the sixteenth century using the concepts of invincible and vincible ignorance. He excused soldiers serving in unjust wars, if they did not know the war was unjust and if they did not have the means to overcome their ignorance; if they had the means, they were morally culpable. In (...) modern just war theory, ignorance is still used both to blame and excuse military service in unjust wars. This essay identifies ten different ways that scholars have used ignorance to argue about the moral responsibilities of soldiers. It then applies the different meanings of ignorance to soldiers serving in Western nations and, using Vitoria’s means tests, evaluates if modern soldiers do indeed have the means to overcome their ignorance. Since many soldiers do have the means, invincible ignorance should no longer be used as an excuse for their service in unjust wars; furthermore, soldiers may, in fact, be morally culpable for serving in them. Both scientific evidence and folklore have suggested that madness is associated with creativity, especially in the arts. Recently, more rigorous studies have confirmed to some extent these previous observations. The current view is that it is not severe and acute insanity that is related to heightened creativity, but the personality roots and soft manifestations of both schizophrenic and bipolar psychoses. The affective and cognitive peculiarities associated with schizotypic and hypomanic personalities may be preferentially related to different kinds of creative endeavours, (...) such as the sciences and arts, respectively. The connection between personality traits and creativity is produced because they share some biological-cognitive-personality features, such as cognitive disinhibition. Additionally, it has been shown that the genetic liability for both bipolar and schizophrenic psychoses is related to creativity. A prevailing hypothesis is that creativity may be one type of 'compensatory advantage' for those carrying the genes for psychosis. (shrink)

Originally, the idea of interviewing Iris Marion Young in Barcelona came about after she accepted an invitation to give a public lecture at the Law School of Pompeu Fabra University in May 2002. I had first met Iris back in 1999, at a conference in Bristol, England, and I was impressed deeply by her personality and ideas. We kept in touch since then and exchanged papers and ideas. She was very keen to come to Spain (it seems that her mother (...) had lived some years in Mallorca) and she finally travelled to Barcelona with her husband and daughter in spring 2002. The lecture, which she entitled "Women, War, and Peace," was meant to be the closing session of a course on Gender and the Law, and was also part of a series of seminars annually organized by the legal philosophy department (the Albert Calsamiglia Seminar). Her work was quite well-known among several Catalan philosophers and political scientists and professor Angel Castiñeira-who, at the time, was the director of Idees (Ideas), a Catalan journal published by the Centre d'Estudis de Temes Contemporanis (Center for the Study of Contemporary Issues)-suggested that she could give a second lecture, which they would publish together with an interview I could prepare. She accepted both proposals, and I started to think of a questionnaire for the interview while I was at Queen's University in Canada earlier that year. Idil Boran, a philosopher and good friend who did her doctorate at Queen's, offered to help me with this endeavour, since she also admired Iris as both a scholar and a person. Together we prepared the questions and sent them to her once she was back in Chicago, as there was not time to conduct the interview in person while she was in Barcelona. In fall 2002, she sent some answers to our questions, but the document was unfortunately incomplete. She was busy at the time, so we didn't want to pressure her to finish the interview. Eventually, the editors of Idees decided to publish the manifest about the war in Iraq subscribed by a large number of American Intellectuals together with fragments of Iris's (antiwar) lectures and an article that she wrote together with Daniel Archibugi, "Envisioning a Global Rule of Law." The interview was thus left unpublished. Both Idil and I thought it would be worthwhile to publish it somewhere else, but, for one reason or another, Iris didn't have the time to complete it and we kept postponing the project. At some point, she said that the questions she left unanswered were too complex or challenging to give a short or quick answer, and that she would need to reflect on them to provide detailed responses. Later, we learned she was ill and we didn't feel it was right to insist on those questions being answered. The issue came up again when she accepted to participate as a keynote speaker at the World Congress of Legal Philosophy held in Granada in June 2005. She then said she would come first to Barcelona (where she and Nancy Fraser had been invited to a workshop by the Catalan Women Institute) and suggested we could sit in a cafe and talk about the issues left out in those unanswered questions. Unfortunately, she had to cancel this trip because of her medical treatment, and I did not have the privilege of sharing time with her again. In recent years, there has been increasing concern about unethical conduct within corporate business, not least because of the scandalous behavior of former chief executives at top blue chip companies such as Enron, Worldcom, Parmalat, and Volkswagen. These scandals have not only threatened the privileged position of senior corporate employees but also the solvency of the companies they manage and lead. The high profile cases of corporate crime and corruption that occurred in the early 2000s together with the 2008 Wall (...) Street bailouts and the growth in criminal prosecutions since have raised the profile of business ethics to an unprecedented level. Greater public sensitivity toward and awareness about the unlawful and immoral conduct of firms in the United States and elsewhere, has created demand for organizations to become more accountable and socially responsible and prompted greater regulatory scrutiny. It has also served to highlight the embryonic and delimited state of research and scholarship on business ethics, where the focus has tended to remain on leadership. A neglected, though important, line of ethical enquiry concerns followership. Corporate wrongdoing would be less formidable and extensive if it was not aided and abetted. Two key questions arise. First, what prompts followers to support rather than oppose bad leaders? Second, what can be done to stem or at least curtail their allegiance to bad leaders? (shrink)

Reconstructive allografts using Vascularized Composite Allotransplantation are providing individuals living with upper limb loss and facial disfigurement with new opportunities for a sensate, esthetically acceptable, and functional alternative to current treatment strategies. Important research attention is being paid to how best to assess and screen candidates for VCA, measure optimal patient outcomes, and support patient adherence to lifelong behaviors and medical regimens. Far less attention, however, has been dedicated to the team science required for these complex VCA teams to form, (...) prepare, and provide the highest quality clinical and psychosocial care to those receiving VCA. VCA teams are unique in that they require specialized team members whose scope of practice may not otherwise overlap. The team also needs to constantly negotiate balancing patient safety with multiple risks throughout the transplant process. This study aimed to elucidate the team science needed for this highly innovative and complex area of medicine. Using in-depth qualitative interviews with 14 VCA team members and observations at team meetings, we found that careful consideration of team composition, team structure, and organizational commitment influences team performance and patient outcomes, but that to be efficient and truly effective, teams need to commit to developing processes that foster collaboration. These processes are action-oriented, strategic and interpersonal. Dedication and commitment to team science allows teams to manage conflict under stress and exercise ways to leverage strengths to provide optimal performance or patient psychosocial and clinical outcomes. This study can provide insight into quality improvement efforts for VCA teams and guidance for other transplant programs that wish to consider expansion into VCA. (shrink)

Preserving dignity during the dying process requires reviewing the roles of those involved in the treatment, care methods and decision-making. This article examines the participation and responsibility assigned to nurses regarding decision-making in the final stages of life, as laid out in the Rights to and Guarantee of Dignity for the Individual During the Process of Death Act. This text has been analysed on the levels of socio-cultural practice and discourse practice, using the critical discourse analysis methodology. The results show (...) that, although the law is another result of the social trend of patient empowerment, the responsibility of the nurses is not recognised, and they are left out of the decision-making process in the final stages of life. El problema de la exclusión social –situación de quienes encuentran cerrado el acceso a los bienes y servicios que permiten un básico desarrollo de la personalidad– constituye un desafío para la legitimidad del sistema social y las normas penales. Principalmente porque ello supone que en una misma sociedad hay individuos con estatus de persona –ciudadanos “normales”, incluidos– y otros que, por estar privados de los derechos asociados al estatus, están total o parcialmente excluidos del mismo. De cara a evitar su (...) instrumentalización penal se propone, en los delitos más conectados con la noción de ciudadanía que con la de dignidad, la atenuación o exclusión de la pena por disminución de la exigibilidad. Si el delito no se explica sólo por déficit de motivación del sujeto, sino también por un déficit de socialización imputable al propio sistema social, lo que tiene lugar es una especie de corresponsabilidad. De igual modo, se profundizará en la dicotomía espacial y discursiva que suponen estas acciones al ser cometidas en el ámbito de lo privado, pero pronto extrapoladas a lo público con fines sen­sacionalistas. Recortes de prensa, fragmentos literarios y pun­tualmente sentencias judiciales serán las fuentes de las que nos valdremos para desarrollar esta (...) investigación con el objeto de profundizar en esta difusa línea divisoria de actuación dialécti­ca. Holistic Learning is designed as a practical guide for teachers on how to integrate curriculum around human processes and human themes. Specifically, problem solving (human process) and mythology (human theme) have been selected as vehicles for curriculum integration. Along with a number of specific strategies for classroom use, the book includes a rationale and framework for integrated studies, teaching approaches in problem solving and mythology, guidelines for writing units in integrated studies, and implementation strategies for integrated studies. The primary audience (...) is teachers at the intermediate and senior levels, although muc of the material is applicable to teachers at all levels of the curriculum. While the very existence of global literary studies as an institutionalised field is not yet fully established, the global turn in various disciplines in the humanities and the social sciences has been gaining traction in recent years. This book aims to contribute to the field of global literary studies with a more inclusive and decentralising approach. Specifically, it responds to a double demand: the need for expanding openness to other ways of seeing the global literary space by including multiple literary (...) and cultural traditions and other interdisciplinary perspectives in the discussion, and the need for conceptual models and different case studies that will help develop a global approach in four key avenues of research: global translation flows and translation policies, the post-1989 novel as a global form, global literary environments, and a global perspective on film and cinema history. Gathering contributions from international scholars with expertise in various areas of research, the volume is structured around five target concepts: space, scale, time, connectivity, and agency.
